Journal Thingy to bring clarity to some idiots

Hello everyone Aval0nX here with another issue of FAN MAIIIIIILLLLLL!!!
in this issue I address a particular issue...THE LEGALITY OF THE CBG AND FURRY PORN IN GENERAL *feel free to discuss in the comments section*

more than once I have received emails expressing concern whether the content of the CBG is illegal or not...usually going by the format of...

Question about Babysitting cream
Hello Aval0nX,
I would like to ask you a question in regards to ( INSERT COUNTRY) laws...
Is this game illegal in ( INSERT COUNTY), if it is, should I stop playing this game?

my common reply is this, if you feel differently from my point of view, fine, elaborate in the bottom comments section, if you agree with me hooraaaayy woopeee go back to fapping...

Dear ( insert name of person)

The contents of this game is illegal anywhere in the world, same as all of the furry and cubby porn out there, I say furry in general because courts can't distinguish ambiguity in furry characters.  (this is sad but true as courts are heavily biased, with religioulous stupidity and find the furry community in general as a perverse sexual fetishistic society)  Like all pirated programs and music downloaded from the internet, even watching streams of copyrighter material is illegal, heck just the fact that I'm using copyrighted, characters from sega and putting them in sexual situations IS illegal.  Should you stop playing the game, if you are underage (which by the sound of your original statement, seems to be the case, you shouldn't be viewing this content) if your parents caught a glimpse of this game and or its contents you could be in a world of trouble.  IF you are however an Adult 18+ > 21+ then you view this game at your own risk, meaning that as long as you play the game, or view it's contents in privacy, and maintain it properly hidden in your computer or away from the computer's history database, then you shouldn't have a problem.  If say for example you where to commit a crime, and the police confiscated your computer and made a search, finding this game, you would be labeled as a sex offender, as would anybody else related to the furry community in general.  (since again in the eyes of a court ANY furry is a sexual deviant, sad but true)  Once again, if you are underage, you shouldn't be viewing this in the first place, and if you are an Adult, stop being an idiot and learn to hide your porn, and how the internet works

most sincerely

So pretty much everything is illegal nowadays, we should view things on our own risk, etc etc.

Completely agree, its like you say, if people dont want to be caught playing this game or keeping it around, then they should just learn to hide there porn and view it in privacy.

agreed in entirety. Sadly, the majority of anything in the world is illegal or so strictly regulated it may as well be illegal. If you wanna fap to cub, furry, alien, or any other porn, feel free. just do it responsibly, and dont go around the town showing it off like some dumbass with a new toy. The world is too regulated to begin with, but if you just enjoy the smaller things in life and listen to the voice in your head saying 'hey, moron, this is BAD' then you will be fine.

Dear _____,

The legalities of this product in your given county for your given situation are far beyond what I care to tackle on a legal standpoint. I'm sorry to say it, but I would prefer not to give you legal advice with my limited knowledge on your laws and your given situation.

Please review your local laws and do what you feel comfortable with. Play responsibly, play it safe.

Sincerely,
Quiet269

Note: Personally, I'd avoid giving any sort of advice like you have in your Journal... if something goes horribly wrong, you don't want that sort of e-mail to show up on a court record.

They will still look down on it, but I'm pretty sure that in America anyways, you can't go to jail for looking at this. Same as for lolicon. It's always been a half and half argument though. Anyways, I don't think it's bad, but that doesn't mean you should be throwing it to everyone.

So much for the idea of "being secure in one's person and mind" as garaunteed by the US constitution...

The fact of the matter is, laws are little more than formalities, a means to an end for accomplishing whatever the people in power want. I don't care who you are or what your interest is, if you are not of the elite legislative or judicial class, if you do anything to step on some important or powerful person's toes, you will be prosecuted and persecuted severely. There are so many interpretations and loopholes in every last paragraph of the legal code that the best lawyers can make them say or mean anything they want.

Having this game by itself, playing it, or even making it isn't really a problem at all. Technically it's illegal, technically it's completely legal. It just takes a better lawyer to make a case for the latter. The main thing is that as long as the game doesn't become a legal issue for them in the first place, it won't be a problem for us.

Respect the game, respect others. That's all there is to it.

Meh...yes and no. TECHNICALLY in some places it's illegal and in others it would be legal. the legality of cub porn in the USA is a bit of a touchy subject but how can you argue it's underage the damn things not even human =p honestly nobodys going to prosecute you on it or even loli/shota unless they have something ELSE on you as well.

as for the legality of MAKING the cream game thats legal as well, your protected under parady law Avalon as long as you do not sell your game or profit off of it your not in violation of any laws. If SEGA realy got a bee in there butt yhey could file a cival law sute against you but if you had the munny to fight it it's unlikely it would hold up much in court, Considering the charicters are all rendered in your art style and only RESEMBLE the copyrighted charicters.

Right. Other than the SEGA logo and the "How could you do such a thing" sound byte, everything on it is original.

The title screen music is from Super Smash Bros. Brawl. The game over screen is a screencap and audio clip from Willy Wonka and the Chocolate Factory. But the bulk of the content, the art, the script, the game programming, is all original work.

That's the weird part. The law does say it's legal. But there's another law that you'd never think to check that directly contradicts the other law. So that's pretty messed up.

In the USA, the supreme court has already set president that laws making any art illegal (in particular cub/lolicon works) is unconstitutional. This president was set when the feds tried and failed to put some guy away for having a massive collection of the art. However this president doesn't mean that the current fascist laws have been repealed. In short what it means in the USA is, they can and will throw you in jail for any thing they please, IF, you do not know your rights and are not willing to fight a legal battle.

This game is for Mature flash gamers only. Anyone under 18 shouldn't even be on the internet in general. This game fetures underage CARTOON characters. Keyword, cartoon, They are not real. Anyone with half a brain will know not to do this in real life. And if you do get such an urge, I have a solution. Go to Ace Hardware, go to the Sledgehammer section. Pick up the heaviest one they have, and hit your junk with it as hard as you can.

Anyone with common sence should know how to veiw this in private, and keep it hidden.

This may or may not fall under the anti lolicon, really depends on the lawyer. In the end though like all things you get off the net if you question it do your homework on it, and if your got a problem writing an email to the creator is about as productive as hitting your face on your keyboard in hopes of miracles typing Jesus. The law says it has to depict an underage girl, the fact its a morphed bunny gril raises more crap then its worth in most cases. Now if you get caught peeping on the neighbors kids, or with free candy in a school zone there with out a doubt gonna seize your hard drive and use this against you.

But the wonder full thing about this is its more of a moral question then legal, since unlike copyright infringement no one is recovering lost profit with a lawsuit, and just like with copyright offenses enforcers care more about large scale distributing then the guy who downloads a few pics a day, its the guy handing out a few million questionable photos a day that there gonna keep tabs on. Also note they care more about real photos since your directly exploiting some kid, hentai, and stuff like this is viewed more as feeding the addiction, or in cases with crazy ass people a stepping stone to horrible shit. If you feel this is illegal look at it like position of a minor drug like pot. Sure you get caught with it you will get in trouble, but as long as your not taking it with you around town, bragging to the world, or distributing it the government could care less unless it costs some one money.

Personally this type of game isn't my normal cup of tea, its the fact that it rivals all the other adult games out there flooding the market in story, and replay value that has me playing it. That and to be honest I think there's shit on my head drive that is not even offensive that could land me in more trouble, keygens etc, but even then I got a shitty upload rate so I can't distribute, meaning they can't sue me for some crazy number of supposed lost sales.

Actually in the legal system, all forms of child pornography or images/video/material of children or characters of adolescent child-like appearance with no specified age, are entirely illegal. However most cases with "cubs" are not even looked at in the judicial system, the reason being is that each animal represented has different life-spans, maturing rates, and the physical representation of anthropomorphism in general is a grey area that has been put on the side, and will never be negotiated through any court justice system. The reason for this is that there is too much controversy, and not enough material of said category that an agreed conclusion can be based off of. As of the moment, all Furry/Cubby pornography of any degree is legal. Though there are borderlines that can't be crossed, such as if it looks too human, or if the character is indistinguishable from humans besides a few key characteristics (example: Cat ears, Bunny ears, tails, etc.), this type of material is illegal if the subjected characters in the material are or look to be under the age of 18. No court will ever hold a case that shows you having just a few pictures/games/videos/material of a character engaged with sexual activities, and there will be even less of a deal if the character is of the age of approximately 15-17, because in cartoons/drawn figures/anime/or any loosely drawn cell-shaded character, defined and distinguishable characteristics are gone at that point, giving a very wide range of ages that the character can be. Professionally published Hentai and pornographic artist have taken advantage of this ambiguity in the physical appearance of a lot of their characters, and are able to get away with it because they have either gone over the fact that the character is at or over the age of 18, or show the individual in a larger group of same-sex people who look to be older, then giving the impression that the character is the same age. For an example, look at the Hentai Dating Sim "Jewel Knight Crusaders". Three of the characters look to be approximately the age of 18 to 23, but there is one character who looks to be about 12 years old; And yet this game is well known and has been translated by the producers and sold around the world including America. So to answer the question... Human + under 18 = illegal,   Animal/Furry + under 18 = legal. Trust me, I've studied the Judicial System and laws of America, Japan, most of China, and a little bit of the U.K.
I also had to learn proper techniques to get away with some of my artwork legally because I was afraid of getting in trouble as well, but I quickly learned that even if you had made the material, and there was a way to trace the information to where you live, as long as it is drawn, you are in no danger. It is a great deal different if you have pictures/video/material of live underage people however, and that will be brought up in court and punished to the highest extent of the law in most cases.

The only photographs of children that I have, are photos of myself from when I was 2-5. A couple of them are actually rather suggestive, with a full frontal view. If anyone were ever arrested having these photographs in their possession, they would almost automatically be found guilty of child exploitation, and be sent to prison, be added to the sex abuser registry, etc., etc..

But, since the photos are of myself, and I now consent to their use in any way I like, could they really be illegal? They meet all the black letter law criteria for child pornography, but cannot possibly constitute child abuse, since I'm no longer a child...

But because child pornography is defined as abuse because it sexually exploits the child, if I used it as an adult for self gratification, technically I would be abusing myself. (In more ways than one...) I'd just like to see a judge pass a conviction on that, and try to order the standard 1500' minimum distance separation from me and the victim, which would be myself...

In reality though, all this is so much of a quandary that no court, nor attorney would ever get themselves tangled up in the matter, because all of the implications attached to it are so outrageous and contradictory that it would screw up the whole system.

Anyway, we'll probably only have to put up with it for another decade or two, then we'll be like Egypt is right now and get to start all over again....

Don't despair people.  Most computers now require passwords just to log in.  Avoid sharing it and avoid downloading anything like that to a public file that guests or other users of the computer can surf and you should be good.  As for getting caught, don't despair.  Newer versions of Mozilla Firefox allow you to delete specific web pages from your history to create convenient gaps as opposed to having to erase the entire lot and drawing more suspicion.  Mind you these rules really only apply to people living with their parents or who are sharing a computer.  If you're working from a PC that is actually personal or a laptop, and if you must use a reminder for your password, do not hide it in your desk or laptop case but your wallet.  Any efforts to accuse you of looking at porn can easily be shot down by accusations of theft.

Oh!  One somewhat risky trick is to use a portable web browser saved to a flash drive that keeps any of the cookies or search history from being saved to your hard drive, and then program the browser to delete it's history and temporary files as soon as you exit.  I say risky because the only thing people need to do in order to access those files are find the flash drive, not exactly password protected.

Your computer's delete function does not fully erase the data from the hard drive, and because of the nature of how hard drives work, even if you overwrite the space where the information you deleted was with new information, there is enough of a residue of the old data you deleted that it can still be detected and read. Most people threatoned with criminal charges try to delete any incriminating files, but police labs easily recover everything deleted in the usual fasion.

I've adopted other methods to protect data, methods I've had to learn because I work with several of my clients vital and personal information, not because I do anything truly illicit. Remember back in the good ol' days of Nintendo, when you had the console as the basic computer core and you changed cartreges to play different games? All those cartreges are, are basic external HDs. I've done the same thing with my laptop. I have several external hard drives, each one is loaded with Windows and is basically a stand alone unit. But each one is loaded with different things. One has all my encrypted work files, one has all my PC games, one has all my public online files, one has all my private files. All I have to do is plug in the appropriate drive, turn on my laptop, and do whatever I want to do with it. When I'm done, I unplug it and keep it physically disconnected from everything else.

You'd be surprised how well it works. It really cuts down on viruses and electronic threats, and automatically keeps all the relevent files sorted nice and neat with their associated programs. Also, when, as happens, I might get a spyware virus or a mole, like when I'm using my public online HD, it can't access any secure information because it can't even reach it. If I ever have any problems with any of the drives starting to go bad on me, I can do a direct copy to a brand new one. Then I destroy the old one by cracking the disks out of the casing and raking them over a high intensity AC electromagnet. There's nothing left after that.

Does your laptop still have windows installed on a hard drive that is located in it permanently?  If so, you may still have some information stored on your computer automatically, because often programs default to making there filewrites to C drive.

Case in point.  The new game, if downloaded onto an external hard drive, which I use for all of my data, still creates its game saves on my C drive.  I discovered this when I answered a person's question about how to transfer there game saves from one version of the game to another, or to delete the game saves. I am trying to figure out how to make FlashPlayer put these saves onto the same drive with the game.

Anyone how does not understand the laws is either an idiot or patheticly optamistic.(I.E. 'They would not bother with me').
Got to live with your internet browsing choices and remember the clear them caches.
The law is stupid, in a lot of cases, an overexagerated reaction from public outcry. I mean, Really, Furry porn is illegal.. thats plain pathetic, but its still the law.
Still, that said, I can't see the feds kicking down your door for it. I.B. patrons would probabally all be locked up by now if that were true.

1)   All personal computers have the ability to have password protection since about 1997-98.

2)   All latest versions of any browser have the ability to delete cache/cookies/history. Google Chrome even has the ability to open an "Incognito" window, that does not record cache, cookies, history, saved files, etc. so you can freely roam the web, and there will never be any evidence (as is any other browser, there is a way, but it's so far out of the way no one will ever find it).

3)   Passwords should never be something that you have the ability to forget, it should be something that means something to you, or is easy to remember, an example would be "Furry9482" (being the word "Furry" and then date of birth). It could also be something simple like a character name, an example would be "Hatake" (Kakashi Hatake from Naruto). Keeping a record of a password will only lead to trouble if there really is someone who wants it.

4)   This thread is about the legality of cub porn and copyright infringement, not "how well to hide your porn".

The inability to provide proper sentence structure and clouded portrayal of your view of the topic, makes most readers lose interest fairly quickly, and any point that is supposed to be made will never get across. Reading any written material, whether it be a novelization or a simple post on a thread, should not be "challenging" to read to the reader. Having to make an effort to understand the subject matter of any written material due to poor sentence structure or a loosely made point (the latter you are not guilty of), is something that should be avoided and is confusing to quite a few individuals. Also a point that needs to be made, homework needs to be done about all subject matter about any written subject before it is posted. This is not just for you, this is for everyone of the internet, and especially all the trolls out there. All facts that are listed need to be just that, facts. Furry porn is not illegal and to my knowledge there is no state in America, and no country in the world that it is illegal. There are plenty of countries where having uncensored material of furries is illegal, but those are the countries where any pornographic material needs to be censored, like Japan for instance. This is not the only subject that is listed falsely. There are too many instances where there has been information that has not been entirely accurate, given from unsure individuals. Please, if you are unsure about a topic's subject, do some research, or exclaim that the information is "to your knowledge", if you don't want to be proven wrong. There is no harm in being wrong, it is a very good thing. Being wrong is how you learn, but please, if you are unsure of the information then do not list it as fact. There are people who might not know or not have an opinion on the matter that will then take that "knowledge" and either claim it as fact as well, or honestly believe it because it is "something they heard".

I don't believe I ever actually implied that you were a troll, as I was talking in general about a larger portion of individuals on the internet. The only disagreement that I had with your post was the grammar and one (just one) incorrect fact. Most of the content after/before that was not directed at you, though I'm sorry you may have felt that way. There is a large quantity of people on the internet that either can't type, refuse to type correctly, Troll, fake information, pass of false information as true, or have a inability to express their feeling on a subject that is either clear or easy to read. The only thing that I "bashed" you on was grammar, and everyone has their own opinion. Most of what was said in that post didn't actually apply to you directly, but was rather a rant about other types of people on the internet that seem to be rushing through the flood-gates lately. You were just someone who started me on a bad rant, and for that, I apologize for any mix up on any superimposed accusations you may have taken by accident.
