Ah, so I guess he owns her or do you? Its always weird when an artist creates a character for a picture you payed for. Like, do I own them because I payed for it or do you because you created them?
In most cases, the original artist probably cant even remember drawing them, never mind having a stake in their ownership. So usually the commissioner gets ownership rights.
