Once upon a time in the United States of America drawn, painted, sculpted and otherwise artistic creations of children not only in adult sexual context but in the nude was made illegal. It didn't last long though because back then the citizens of this nice little country had cahoonas about them. It went to the high court and it was determined to be unconstitutional, and that was that. These days some people confuse the Miller / Three Prong Obscenity Test with basically allowing the system a work around where authorities can be passive concerning the higher court determining that artistic creations of children in "adult" context are protected, but if one does a little home work they will see that its not only nothing to fear, but the Miller test in that it is so vague in parts or in whole that it struggles to be used for the purpose it was made for, and there is heavy consideration to just drop it from the legal system.

There have been arrests in the US but in those arrests the art content found on computers was not what those individuals where charged for, they were charged for the real child porn found there along with it. The media, God bless them everyone (/sarcasm) really likes to play up the artistic stuff though along with the real stuff, cause it adds to the sensationalism. In Canada artistic child porn, including furry/cub porn is illegal, due in part because they want to empower the police to search those computers they find out it is on, for the belief that where there is pornographic art there is also actual pornography.
Just like in every other kinda set up, some things fall through the cracks, and sometimes when these things happen people are wrongfully accused and sentenced. Everyone who knows about the lacking shining perfection of the judicial system knows that there have been more than a few people found guilty of murder and wrongfully sentenced to prison and even death. If a person can go through the judicial system and be found guilty of that then you can darn sure bet that they can be wrongfully accused and sentenced for pretty much anything under the sun, and truth be told... people have been. So, yes there have been very few instances where individuals have been convicted for creating and or possessing art of child characters in adult context, but, this doesn't mean the world is ending as far as those things are concerned, it pretty much means that the individual who ended up going to jail and his defense team failed to stand up for themselves.
It's not difficult to see that there are several sites who host cub porn and seem not to have the issues that Dragoneer and Friends (said like Fox News and Friends) have with it. Not only that but there are sites that cater specifically to only cub art, like cubcentral.org where the porn to no porn content ratio is a lot higher than the chicken little screamers on FA ever thought of in their worst nightmare wet dreams. Cubcentral has been up and running more consistently than Furaffinity has for more than twice as long. Not only that, but sites like hentai-foundry.com and y-gallery.net host, get this, LA GASP actual plain and simple artistic kid porn like shota and loli art, and they've been up for years! And ya know what, there have been more than a few sites on the internet that hosted plain and simple actual kid porn, and God bless them (not sarcasm at all) the FBI comes right along and takes em down, rather swiftly and rather effectively. You don't hear about that among the furry chicken little (The sky is falling, THE SKY IS FALLING!!!) crowd because they don't represent actual law, they represent conservative moral thought police that like to scare us into submitting to being their little puppets and only behaving in the manner that they wish. So long as a site is not hosting illegal content and holds to their responsibility to take down illegal content if its posted and report the perpetrators if its something like actual child porn to the authorities, the FBI and that bunch have bigger fish to fry. It will take a little homework to find out that some of the sites that host cub porn and / or shota do get freaks who actually post really illegal content to the servers, and admin and mod staff have had to remove it and gather info to report it to the authorities. It's almost really simple to figure out if you think about it, for all the dweebs who will report a site just because they think it should be against the law, and for all the fuck munches who post illegal content to those sites, sometimes deliberately just to get them taken down... When a site has been up for a few years, here's what it means.... They're doin it right! Know what I mean?
It's a fickle world indeed, and the lines are sketchy enough to not go at things lacklusterly and care free, but we don't have to listen to the scare tactics and fear mongering either. Do your homework a little and you will see that what's not against the law is allowed to stand, and whats illegal has been taken down, and not only that but the matter has been argued in high court in the United States and the decision has been made and that particular will not be reviewed again. The Miller Test may not exist in the near future, but there is a possibility that something will be written up to take its place. If its not acceptable to the artistic community then its their burden to stand up and say something about it and to make sure the governmental error is corrected, like they used to do when they had balls about them.
But as far as having balls about them when it comes to standing up and defending the right to true freedom of expression, don't expect Dragoneer and his butt buddies to be there for ya.
