An open apology...

Hey guys,

First off, If you're intent on hating me no matter what, then don't bother reading this journal.

But if you believe that I'm just like you- human, fallible, and hopefully willing to admit when I'm wrong, then read on.

Recently I was made aware of a troubling situation involving Starfinder, or “Kannos” as she's known in some circles. To put it bluntly, I used a pose in one of her sketches in one of my Sexyfur submissions earlier this year (which has recently been removed from the site). Yes, I know this was wrong, but I'd like a chance to explain why I did what I did.

A couple of years ago, Starfinder approached us at Sexyfur and asked to work with us. We liked her work, and agreed to let her work with the website. We have a “sketches first” policy, so she sent in a few of them, which we approved them all.

Shortly thereafter, she took down her galleries, and seemingly disappeared...not letting us know that she wasn't  interested in working with the site anymore. What's more, she had stated in one of her journals that she was no longer interested in doing adult artwork. I was disappointed at this, since I really liked one of the poses that she had drawn.

I waited for quite some time (1 1/2 years) to see if she would change her mind and perhaps come back, but unfortunately that didn't happen. I figured that since she wasn't interested in finishing the image anyway, there would be no harm in using the same position/pose/angle in an image of my own.

This was a horribly wrong assumption.

As you can imagine I'm incredibly embarrassed at my own shortsightedness and unprofessional behavior. I apologize to her and to anyone I may have offended with what I've done. I also apologize to all of the artists that work with the site, and promise that the same won't happen to you.  Bernal has already been made aware of the situation and I've already made amends to both him and Starfinder for my error. Whether or not you're able to look past my fault, there it is. All I can say is that I'll try to learn from my mistake. That's all anyone can do honestly.

I don't think there's anything wrong in referencing a pose as long as it's cited where ya got it from.

i didnt see such a huge problem with it, it was a pose, i mean yeah i would have been mad too but, its by no means theft like everyone was trying to call it just for attention.

im hoping they at least came to talk to you about the situation before they tried to start some huge flame fest over something like this.

well anyways its resolved you apologized so hopefully i wont have my inbox filled with more unnecessary crap

Umm. As Kayla said above, there's no harm in using a picture as a reference for a pose. Unless you blatantly traced it, there's nothing really anyone can do about it.

Yeah... where's the wrong in using a pose? Just add credit to the author and everything should be cool... :/ Beside, you said it was an unfinished drawing... so what's starsmurf's problem?

When you say "you used the pose", does that mean you just inked the image, or you used the pose as a reference for a wholly different image you did?  Because if it's the latter, you owe no apologies.

Yeah, I don't see anything wrong with using a pose :/ People use the same poses all the time, even when not meaning to. The humanoid body can only be posed so far, so more than likely two people are going to think of the same pose anyway, so a pose shouldn't be fret over. A character, though... That's another matter.

What is a 'pose' and how the hell do you copyright/own that. You don't own a 'pose' unless I am mistaken and this is something different. We are talking about sexual positions right? If I am wrong then disregard. If I was correct in my assumption... WTF!?!

Yeah can't copyright a pose, like previous person said: unless it was blatantly traced I don't see a problem with using a similar pose.

you just used the pose? how is this an issue... lots of artists get there poses and positions from various other sources... called a reference i dont see how using same pose as the image in question is a problem... as long as you didnt trace or, take image in question and color it and call it your own in this case you simply need to cite where the image itself came from(the sketch) i do not see a problem with using poses others have done in fact some really great work is often inspired by another image the artist has seen and so uses that idea in there own work.

Well...I wasn't even sure HOW bad this whole snafu was but the fact that you as an artist in the furry fandom is making a straight-up apology for an oversight that went out of control, is something that makes me respect you all the more.  This kind of humility I love seeing more of nowadays from people.  So you rock.

No. No, I... I refuse to buy into this "Artists can own poses" garbage. That is unchecked ego run amok, and unless you traced it completely, you have nothing to apologize for in the least. Further, anyone who grieves you for doing so is themselves wrong, and should apologize for being an absolute, utter tit.

I pretty much mirror the sentiment given here, it was just a pose, lots of poses are used over and over again in art especially when they are sexual poses.  How many times have you seen someone giving head, do you credit the first person to do it, photograph it or draw it?  no because it is just a pose.  I have seen the picture in question and there is no doubt the pose is the same, but the art style and characters were extremely different.  I don't feel you did anything wrong, but I do commend you for being the bigger person and removing it and apologizing.

Even jesus made mistakes. As far as I see it, you didn't do anything that is actually wrong.
Every pose possible, has been used at least a dozen times, by different people.
So no one should have claim to a pose.

What's "unprofessional" is thinking that any poses that aren't EXTREMELY specific or iconic can have a copyright. Unless you're Viewtiful Joe or something you don't get to own a kinky pose.

Artists need to get with the program and realize that their shit's simply not that important. They don't need to copyright it and worry about people stealing their ideas. It's pathetic and petty.

It's not wrong to use a pose that someone else drew. They don't hold a copyright on the human figure.

An artist complaining that you referenced a pose they drew seems significantly egotistical, and likely a pose she referenced herself. I'm convinced that there are artists out there who will jump at any miniscule opportunity to bitch about being plagiarized, or about having their copyrights violated in some way shape or form; makes 'em feel more valuable than what they really are.

I suppose she'd complain about being copied if you sketched a tree in her yard.

*rolls eyes* I've never understood why people get upset about such things as using the same pose. There is a finite number of ways to pose and a finite number of angles to view them.

The only downside is if someone with great skill (yourself) does the same pose, it can kind of one up someone of lesser skill (myself) but on that hand, I could use your higher quality image to help with my own.

No offense, but I prefer you speak with your art.  :)  How does one reference a pose anyway?  Unless you used the sketch line for line, you re-drew it.  Fair-use clause, IMO.

I seem to recall this crap happened on Fchan back around 2005. Someone claimed copyright on a pose and attempted to have all images using said pose removed. There's nothing wrong with a pose or a camera angle or using both at once. You're fine as long as you don't trace.
