In the beginning...

Inkbunny's founder was once a happy Director at "ACME Computer Co." with dreams of corporate wealth and success.

But after devoting all his time and money to "ACME Computer Co.", working 7 days a week for over 5 years, all he got in return was a lot of stress, wasted time, unhappiness, bankruptcy and a stomach ulcer.

He decided it was time to do something rewarding and fun instead, even if it wouldn't make him rich.

From that day forward he vowed to use his management and coding super powers for good, instead of evil.

So he fired himself from his old company, and then dedicated his life to creating his dream art site.

He would give something back to the furry community that had given him so much over the years.

“I can make my dream art site in 3 months!”, he inaccurately said. And 12 months later, with a lot of help from good friends, it was ready.

The result is a community art site that regards freedom of artistic expression as a top priority, gives users as much power over their own accounts as possible and provides professional tools for artists to showcase their work, sell it or share it freely.

The Inkbunny team takes great pride in its professionalism and conduct. Inkbunny is run as a professional commercial site, while maintaining its focus on benefiting the furry art community.

Inkbunny will always be free to use. Inkbunny does not make money off paid advertising, sales fees or membership fees.

If you want to support the Inkbunny community, the best way is to support the artists! By purchasing their work, you encourage them to make more of the art you love, and to work on bigger and better projects.

Donations directly to Inkbunny go towards funding hosting costs, staff costs, business costs and the continued development of the site and its capabilities well into the future.

We are always looking for ways to improve Inkbunny. Please contact us with any suggestions. We have a reputation for implementing cool ideas very quickly.

Transactions, Currency and Fees

All prices listed through the Integrated Sales System on this site are in US Dollars ($USD). Artists may advertise items without using the Integrated Sales System, in which case you need to confirm the currency with them.

For the purpose of sales, Inkbunny acts as a tool for advertising and communication between Buyers (also called "customers") and Sellers (also called "artists"). We are not responsible and cannot be held liable for sales, payments or any other official business between buyers and sellers.

Taxation, exchange and transaction fees are the responsibility of the buyer and the seller.

Some important things

You must back up your work. Always keep copies of all work you upload to Inkbunny. We are not an archiving service and do not guarantee your data from loss.

Everyone using this site must adhere to the Inkbunny Philosophy.

All work you upload must meet the requirements described in the Acceptable Content Policy.

All your uploads must comply with the Keyword Policy for assigned keywords.

It is essential that Inkbunny users respect copyright. You must be the copyright owner of all content you upload to Inkbunny, or have permission to upload it. For further information about copyright please refer to our Acceptable Content Policy.

You need to be aware that uploading and sharing your work via Inkbunny, and using this site in general, gives you various legal responsibilities. It is up to you to make sure you are not breaking any laws by sharing or selling your work through Inkbunny, viewing content, or any other activities you conduct on this site. We do not warrant by providing these services that your use of them and the material you view or upload is legal in all relevant territories.

Respect each other and the artwork on Inkbunny. That may be the most important rule here. Users have the power to block troublemakers, and to delete comments from their own accounts, all without administrator intervention. Serial offenders found abusing Inkbunny members will be site-banned without warning or discussion.

Moderators on this site are volunteer members of the Inkbunny community kindly providing their time for free to assist in running this service. Their actions and views they express are their sole responsibility and do not represent those of Inkbunny or its owners.

Legal Agreement

All visitors to this site and all members are bound by this User Agreement, and all the details and rules stated on this page and any linked references. The agreement is between you and the owner of Inkbunny. Use of this website and/or creating an account on this website indicates your acceptance of this agreement.

The interperetation and meaning of subjective terms in this contract such as "reasonable", "significant", "acceptable", etc in this contract is at the sole discretion of the owner of Inkbunny, or appointed representatives.

Age Restriction and Eligibility

The Inkbunny website and all its services are restricted to adults. You must be legally recognised as adult in your state/country AND you must be at least 18 years old to use this site and its services. If you do not meet these requirements you must leave Inkbunny immediately.

Amendments

This contract may occasionally be amended. Amendments may appear without warning. We will endeavor to inform users of any amendments via Site News announcements. Whether you are informed of the amendments or not, you agree that your continued use of this site indicates your acceptance of any new terms.

Service

Inkbunny provides users with a wide range of services. These include, but are not limited to, letting you share and sell artwork, music, animations, etc; to discuss and purchase this artwork; interact with other members; give and receive donations; use Inkbunny's payment processing; transaction handling; product manufacturing (by Inkbunny or authorised third-parties); digital content sales, hosting and download; and customer service.

The content on the website can be information, text, data, graphics, images, photographs, sound, video, music or any material posted by users.

This content can be described in this agreement in many ways including content, work, artwork or art. Your art can be viewed by all users of this website once you upload it to Inkbunny. If you or a customer place an order for the artwork, it will be provided in the form specified by you or the customer.

Members

You can become a member of the Inkbunny website by creating a registered account. This account has a unique username and is protected by a password. Only members can post artwork or participate by commenting on accounts, artwork, journals, etc.

"Member" in this agreement can refer to buyers, sellers, or any registered user of the Inkbunny website.

We reserve the right to refuse membership to anyone, at our sole discretion.

We reserve the right to refuse or change usernames that we deem inappropriate.

We reserve the right to change your username or delete your account and/or terminate this agreement to resolve issues of name-squatting, impersonation or any other reason we deem appropriate.

Any information you transmit to Inkbunny may be viewed by members or non-member visitors to the site. It may also be linked, recorded, viewed and distributed within the site in the course of providing the Inkbunny service.

Your privacy is important to us. For more information please read our Privacy Policy, which forms part of this agreement.

Passwords and Protecting Your Account

You are responsible for choosing, using and protecting your password and protecting access to your account. You are also responsible for protecting your account from individuals accessing your computer or public computers you have used to log in to Inkbunny. Your login session may persist even when you leave the computer unattended, close your browser or turn off your computer. It is your responsibility to ensure you log out and/or clear your browser cookies and saved passwords to ensure no one else can access your account. You are responsible for any actions taken using your account, including posting content or making purchases, even if these actions were not approved by you. You are solely responsible for any breach of this agreement, or loss, as a result of anyone using your password or account with or without your consent.

You agree that you will never give your password to any other person, and you will not keep your password anywhere it can be copied or stolen by anyone.

If you suspect someone has stolen or compromised your password or account, you must change your password immediately through the account settings page and then inform a Moderator or Administrator.

Posting Content

You keep copyright of any content posted to Inkbunny. For us to provide these services to you, you grant Inkbunny non-exclusive, royalty-free license to use and archive your artwork in accordance with this agreement.

When you submit artwork or other content to Inkbunny, you represent and warrant that:

* you own copyright to the content, or that you have permission to use the content, and that you have the right to display, reproduce and sell the content. You license Inkbunny to use the content in accordance with this agreement;

* you and your content do not infringe the intellectual property rights or other rights of any person or entity, including copyright, moral rights, trade mark, patent or right of privacy;

* you or your content, and your use, storage, reproduction and display on the website will comply with all applicable law, rules and regulations;

* your content does not contain material that defames or vilifies any person or group of people and is not harassing, threatening, harmful, invasive of privacy or publicity rights, abusive or inflammatory;

* your content does not include malicious code, including but not limited to viruses, trojan horses, worms, time bombs, cancelbots, or any other computer programming routines that may damage, interfere with, surreptitiously intercept, or expropriate any system, program, data, or personal information;

* your content is not misleading and deceptive and does not offer or disseminate fraudulent goods, services, schemes, or promotions

Inkbunny reserves the right to remove any content or to cancel your account and terminate this agreement at its sole discretion for any reason it deems appropriate.

Selling Art and Accepting Donations

Members that offer artwork for sale or accept donations through Inkbunny agree that Inkbunny is purely an advertising and sales management tool, and that ultimate responsibility for all transactions and legal issues resides with the buyer and seller.

Payment terms are the responsibility of the seller.

Buying Art and Making Donations

Visitors and members can purchase artwork or make donations using any payment method supported by the seller.

You do not have to be a member of Inkbunny to make purchases or donations, unless the seller insists.

The price of all transactions is fixed at the time of payment.

You cannot cancel an order once it has been paid for and correctly delivered (this includes digital files), except with the express permission of the seller.

Donations cannot be refunded except with the express permission of the seller.

It is the customer's responsibility to ensure all details provided are correct. This includes, but is not limited to, delivery address, email address and other information required to complete the transaction, sale and delivery of purchased goods.

Inkbunny does not warrant or endorse any content provided by members.

Disputes between buyers and sellers

The ultimate responsibility for settling disputes rests with the buyer and seller. However, Inkbunny may act as an arbitrator if either party requests our assistance. In all cases, our advice is given as unofficial assistance and cannot be used as an indication of our responsibility or liability in any dispute.

Damaged Products and Refunds

As Inkbunny has no control over transactions, refunds are provided solely at the sellers discretion.

Buyers seeking refunds without reasonable cause or Sellers failing to provide refunds in reasonable circumstances may be considered in breach of the Terms of Service and may have their account suspended or terminated.

It is considered a reasonable cause for a refund when the delivered item differs significantly from what is advertised.

Each seller is responsible for their own damaged goods return, refund or replacement policy. However, we expect that if a product is delivered and is damaged in some way (for example a file does not download or open correctly) the seller must seek to remedy the situation for the buyer in a reasonable way.

Customers must contact the seller within 14 days of receiving the product and inform them of the nature of the problem and to arrange for a replacement to be sent.

Inkbunny is a creator-controlled publishing and sales tool. We do not screen the content made available on this website. It is the customer's responsibility to verify the quality of the content (such as misspelled words, grammatical errors, design, appearance, etc) before ordering the product.

Inappropriate Content

Inkbunny does not review content before it is displayed. Occasionally members may inadvertently or deliberately submit content that breaches this agreement.

Inappropriate content includes, but is not limited to, material that breaks any relevant laws, defames or vilifies any person or group of people, is harassing, threatening, harmful, invasive of privacy or publicity rights, abusive or inflammatory.

Please let us know straight away about any content you see that may be in breach of this agreement.

If you think your copyright is being infringed by any artwork on this site, please make a formal complaint detailing the artwork and proof that you own copyright to the content in question.

It is your responsibility to ensure that your use of this website and its services is not illegal or prohibited by any applicable law.

It is your responsibility to ensure that the way you use the Inkbunny website does not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage own computer system. We do not accept responsibility for any interference or damage to any computer system that arises in connection with your use of this website or any linked website.

You acknowledge that we may not be able to confirm the identity of other registered members or prevent them acting under false pretenses or in a manner that infringes the rights of any person.

Intellectual Property Rights and license

All intellectual property rights in this website and the Inkbunny service (including the software and systems underlying the service, and text, graphics, logos, icons, sound recordings and software) are owned by or licensed to us.

Other than for the purposes of, and subject to the conditions prescribed under International Copyright Law, you may not:

* use, adapt, reproduce, store, distribute, print, display, perform, publish or create derivative works from any part of this website; or

* commercialize any information, products or services obtained from any part of this website,

without our written permission or permission of the copyright holder.

Trade marks

You must not use any of our trade marks in or as the whole or part of your own trade marks; in connection with activities, products or services which are not ours; in a manner which may be confusing, misleading or deceptive; or in a manner that disparages us or our information, products or services (including this website).

This website may contain links to other websites. Links are provided by Inkbunny members or by the Inkbunny service. Those links are provided for convenience only and may not remain current or be maintained.

Links provided by Inkbunny members are not reviewed or controlled by Inkbunny.

Accordingly, by entering into this agreement, you state that any information that you transmit to us, and is stored by us, is transmitted and stored at your own risk.

Termination of access

Access to this website may be terminated at any time by us without notice. Our disclaimer will nevertheless survive any such termination.

Governing law

This agreement is governed by the laws in force in the jurisdictions in which we directly operate, and not the jurisdictions from which this site may simply be accessed, or in which you reside. You agree to submit to the exclusive jurisdiction of those relevant courts we deem appropriate to resolve any particular dispute or legal issue, at our sole discretion.

Arbitration

Any controversy or claim arising out of or in connection with this agreement may, at our discretion, be settled by binding arbitration of a professional third-party arbitrator chosen by us. You agree to be bound by the decisions of the chosen arbitrator in that case.

General

We accept no liability for any failure to comply with this agreement where such failure is due to circumstances beyond our reasonable control.

If we waive any rights available to us under this agreement on one occasion, this does not mean that those rights will automatically be waived on any other occasion.

If any of the terms of this agreement are held to be invalid, unenforceable or illegal for any reason, the remaining terms and conditions shall nevertheless continue in full force.

Privacy Policy

Inkbunny respects your privacy. Our privacy policy applies to all services provided by Inkbunny through this website. For the Privacy Policies of external sites used to help provide our services to you (such as external Payment Gateways), please refer to the policies of those individual and separate sites when you are redirected to them.

Administrators and Moderators of the Inkbunny service may have access to any information you upload to the website, including all communications such as Private Messages. No information or content uploaded to our site is to be considered guaranteed confidential or safe from access by individuals other than those you intend it for, even when the information or content is listed as "not public" or is referred to as "private" or accessible only by certain people.
