One of his mechanics saw a noose in their garage (which are apparently rotated among drivers regularly), and reported it. The driver never saw the noose, NASCAR officials acted quickly denouncing it and a lot of show was made of support for the driver. Subsequent investigation found that it was not a noose, but the pull line for the garage door was done in a loop, likely for better grip (this was the only one done in that configuration on the premises). Video logs show it had been like that for MONTHS, far before anyone knew which driver would be assigned that garage. It was a mistake that got a lot of attention, but was not an intentional deception.

Problem is that we've seen the photos showing that the "noose" has been tied into every garage door's draw string.
Wallace and his crew aren't a bunch of first time amateurs who have never been to these garages before and as you said yourself, the garages are rotated, meaning that they've seen several other garages with loops tied into the draw strings - they probably tied a few loops themselves over the years when they replaced old, rottened draw strings.
As such, if you know that something is not a hate crime yet you claim it is anyway then you have both action and intent.
The fact that rather than apologizing after it was publicly proven not to be a hate crime, but instead, Wallace continued to double down and insist that it was further proves malice and intent on his part.
Think about it - if you accused someone of something that horrible and then had it proven to you beyond a reasonable doubt that you were in error, would you apologize - or at least drop it - or continue to insist that person was guilty even after you knew for a fact they were innocent?
