Theoretically, yes. But of course in any fight, the point is to win it, and in this case, by any means necessary. Using it just this once, he might feel a little nauseated afterwards. If he kept on going though, yes, he could kill himself. But if that's what was required to bring down his enemies... well, isn't that what a hero is supposed to do?
