The Federal Government is going after your porn (again)

Frequent Fliers to E621.net will have already seen the Arizona State ID Law that is waiting on the Governor to sign/veto it. However, we have a much bigger, much more ugly fight coming up.

IDK about the Daily Caller as an organization, I saw a Washington Post article about the bill from April 10th, and am digging for other mainstreamish coverage. So, that lead me to check out Senator Lee(R, Utah)'s page.

I hate doing posts like this, but things keep happening so if you're in the US you need to put in your letters and phone calls to your representatives. I'm sure Demand Progress or whatever will have a campaign going for it soon.

This will of course have international consequences. If we kill the Miller Test the current precedent in the courts basically exists to allow the acting parties (such as state governments, any soccer moms, etc) to sue website companies for hosting Obscene content. What counts as Obscene depends on the Miller Test in the court- but if we remove that test, you don't really have to prove it very hard. The Miller Test requires effectively a Jury of your Peers to rate your content, it has a few other elements to it which basically make it a SHITTY but known variable.

Removing the defense entirely means the government can use the overly broad definitions to just splash whoever or whatever with a claim of Obscene Content and the courts wouldn't have to even consult anyone else aside from the defense, who would have no case. https://www.justice.gov/criminal/criminal-ceos/citizens...

Read about the existing Miller Test, think about how broad it is, how shitty it is, and then remove the specifics and read the overall definition of Obscenity. This was used to run porn shops (brick and mortar kinds) out of business in the 1960's. It's oldschool fascistic censorship of free expression while claiming to defend kids, and that's obviously bullshit.

Be ready for this. It could be on us. Save your shit, save shit you like, and maybe even get ready to close up shop and cover your tracks. If it passes, NSFW Patreon is gone. NSFW SubscribeStar is gone. Hell most things that are ART that are remotely queer are liable to be stricken down without having to remove Section 230. Every website doing business or being hosted in the US has obligation to comply with Obscenity Law baked in.

By expanding the definition of Obscene Content and removing the protections that the courts might entertain, the MAGGOTS want to fucking destroy your hobbies and community spaces. This affects you.
