Terms of Service

Here are the guidelines to my Terms of Service when commissioning me for artwork. Please read carefully and if you have any further questions, do not hesitate to ask me.

Disclaimer:

- You must be 18 years or older to commission me, regardless if the project in question is Safe For Work (SFW) or not.
- You accept that I have the right to refuse any project at any time.
- You accept that I have the right to refund a commission at any time. Reasons would most likely be unforeseen circumstances which may disable me from continuing your commission.

Art Status:

Requests: No
Trades: Sometimes (Usually with friends or artists I admire)
Collabs: (Same as Trades)

Payments & Payment Types:

- Paypal and Ko-fi are some of the payment methods used for such transactions. Other forms of payment are acceptable as well. Please discuss them with me if you have an alternative payment method.
-Prices seen on the current Commission Info Page are in United States Dollars (USD)($) Currency.
-Prices are subject to change due to the quantity of characters in the artwork, the complexity of the subject’s design, revisions, the complexity of the background, and or by the amount of shading and colors used.
- An Invoice will be sent upfront via Paypal or Paypal link.
-I must receive the full payment upfront before I begin the project.
- Invoices are required to have at least one payment on them within the first 3 days of it being sent.
-If the time frame passes and no payments have been made, then I uphold the right to cancel your commission without notice.

-Underage human characters engaging in or around sexual actions. This includes characters that biologically look too humanoid that they resemble minors.
-Scat, urine, vomit, snot
-Extreme vore
-Extreme violence, excessive blood and carnage

I Prefer Not to Draw:

-Extreme Realism
-Extreme architecture
-Mech, complex armor
-Realistic ferals
-Bulgy Muscles
-Graphic sexual assault
-Extreme obesity
-Crowds or loads and loads of characters
-Historical, religious, political and or cultural characters or subject matters

Communication & Etiquette:

During the commission process, we must communicate effectively with each other. This means:
-Responding to notes in a timely manner.
-Being clear and concise with what we want.
-Treating each other with respect.
-Keeping it professional, of course. Please no role-playing or other irrelevant talks while we're discussing the commission. Save that for another time.

I may ask you multiple questions pertaining to the commission, so please be patient with me. I want to make sure I am fulfilling your request.
I will send you my progress from time to time if you desire via Deviantart's Sta.sh website links, email, and or Discord depending on the size of the file. The commission draft will have my watermark on it. It may not be removed but you can ask me to lower the opacity.

References Images:

-I very much prefer to receive a reference image of your character, it makes things easier to see and create on my end.
-Text descriptions are fine too. It may take longer to get the piece right, but so long as we're actively communicating and what you're writing is clear and concise, it shouldn't be a problem.
-If you want me to draw someone else’s character (OC), then you must have proof of their consent to allow me to draw them.
-If it is a surprise drawing, then the character in question must be allowed and free to be drawn by me. I will also need proof of this.

Editing and Revisions:

-You are allowed 3 revisions during the early stages of the commission process.
-Said revisions must be reasonable.
-If more than 3 revisions are needed, extra charges may apply.
-A completed commission cannot be edited.
-I have the right to reject revision suggestions if I see fit.
-I have the right to add additional charges if you want me to discard my entire, original sketch or animation and start from scratch.
-I have the right to reuse said sketches or animations for future projects of mine if they were rejected.

Refund Guide:

-You may request a full refund if I have not begun the commission in 1-2 weeks.**
- Your refund will be given to you within 1-2 weeks.
-If the artwork is already being worked on by me and I am still in the very early stages of it, then you may request a partial refund. The percentage I give back to you again depends on how far along I am.

**This of course depends on how many commissions I’m taking at that time. Depending on the order of projects I have to do, chances are I won’t get started on the early stages of your project and I won’t have to scrap much once requesting a refund, if it’s further down the list. But if your commission is towards the beginning of the list, then I would be starting it.

Refund Guide for Animated Commissions:

-You may request a full refund if I have not begun working on your animation in 2-3 weeks.***
-Your refund along with your invoice will be given to you within 2-3 weeks.
-Depending on how many frames have been drawn so far, you will receive a partial refund mirroring the work put into the animation so far.

Reposting and Sharing Guide:

- You must agree that I reserve all artistic rights to my artwork which include commissioned pieces.
-If I decide to use commissioned works in other social media sites, galleries or even in real life (IRL), then I will credit you as the Commissioner accordingly unless asked not to credit you ahead of time.
-I reserve the right to stream the commission online.
-You are allowed to repost commissions I have fulfilled for you, but you MUST credit me as the artist who created it, and you must provide a link back to my profile. This includes a link back to: my user page, my gallery, and or my commission sheet.
-My signature must be on the piece but you can choose where you'd want it to be and its size, so long as it's visible.
-You are not allowed to distribute or save commission drafts unless I say so.
-You are not allowed to use my artwork I have provided you for commercial use or for profit.

Animation Commission Info:

Animation Commissions are based on how much time I believe I am able to spend on the project in question as if I were working on it nonstop. The days listed in the Animation Commission Sheet are estimates that I determine through your description of the animation. The complexity of the piece includes motion, character designs, character count, background, colors, details and more will all be taken into account when coming up with the days and price.
For whatever reason, I may spend a shorter or longer amount of time than the day and charge chosen due to other commissions, unforeseen circumstances etc. However, this does not mean that the price will decrease or increase; whatever the original price I determine to be still stands.
Example: You ask for an animation and according to your description, I believe it’ll take 3 Days for me to complete; your price is $X. As I continue to work it turns out I have other projects to do that are quicker, or I need a break, or the animation will take longer than expected for me to do. 1 Week later, your animation is complete. You will not be charged additionally as if you were paying for a 1 Week Animation Commission; your price is still $X. The same rules are applied if I were to take less time on your animation.
Feel free to ask me any questions if you need clarification.

The Commissioner must read, understand, and agree to all of the terms above before continuing the commission with me, the Artist: KAN0101/ KAZOKO.
By proceeding and sending the payment, the Commissioner comprehends and consents to the above terms. These terms are contractually bound to the Commissioner.
Thank you.
