I am the owner of the Tumblr account for the site http://lamiaponies.tumblr.com/, and I have received this notice of termination. However, I must appeal this action as I believe the reasoning for termination is not in violation of the Terms of Service or Guidelines defined for Tumblr.com.
The content featured on the Tumblr in question does not violate the policy as stated:
Harm to Minors. Be thoughtful when posting anything involving a minor. Don't post anything relating to minors that is sexually suggestive or violent. Don't bully minors, even if you are one. Life as a teenager is hard enough without the fear, anguish, and isolation caused by online bullying.
The content contains no 'minors' under the definition of law, a person under the age of 18. Fictional characters are not defined as 'persons' and thus 'minors' as such, and by the Supreme Court decision of Ashcroft v. Free Speech Coalition, under the law, the acts of those in non-realistic artistic mediums that may be interpreted as 'minors' engaging in activities that would be deemed inappropriate or unlawful do not apply.
This also brings up an inconsistency with the notification in the E-mail, as I will point out:
As per the policies you agreed to when creating a Tumblr account, we do not allow inappropriate content or depictions involving minors or underage characters on Tumblr.
In the policies, there is no mention of agreeing to not post content or depictions involving underage characters, which will be interpreted to be fictional characters, and in the interest of clarity, the guidelines must be clear on this issue to prevent further misunderstanding. In the current state of the guidelines, none of the content on my Tumblr has violated any policies.
