In order to fund both my cat's physical needs, and other expenses to run the household,
I'm in need of commissions. Every paid piece will be given priority, and all work will
be held to the highest quality.

WIPs can be requested to be posted here in the gallery, at the commissioners discretion.

cellshade - $25
backgrounds - +$10 (simple bg's & minor objects are free)
comic pages - %35 comm. price x number of panels
painted - not doing at this time as they are severely work intensive, but perhaps later

additional characters- +60% of commission price (waived in comics containing 2 or less characters)

** no additional charges for fandoms, though over-complicated designs you need to ask

** commissioner is allowed to post any and all artwork commissioned in their gallery,
as long as they provide a link to the original one in the description & give credit!
** commissioner is NOT allowed to alter the work without my consent at any time,
nor pay any other artist to do so

Unfortunately it is, as in the past I've had someone commission a sketch from me, and have someone else line/color it because they perceived it as being cheaper that way. ^ ^;; I'd rather say I warned people and they agreed to such terms, than come up on sticky territory.

Well lets say I liked the way you drew anatomy and the like. But, I found your ability to convey colour and depth through shading was sub par. Would you be opposed to that?

Or maybe I thought your pricing vs perceived quality was skewed?

I'm not saying that this is the case, I'm just curious as such clauses are... Bristling. I'd sooner have freedom of ownership rather than risk a vindictive stonewalling. (Ownership in so far as owning the digital copy. Not the effort and technique behind it.)

That's a misconception. :3
Such a clause is actually quite common of the ToS of MANY artists.
As these are my ONLY rules at the moment, I'd assume I'm pretty much the most lenient artist right now.

Buyers DO have ownership of the digital image. They paid for the rights to enjoy/put the image in their gallery.
The characters are theirs, but the common misconception is that they own the artwork itself. That is not true. IP law states that the ARTIST owns all redistribution rights and retains all rights unless sold to a third party. Usually owning the FULL RIGHTS to do something like that/alter the image/use it how they want, is significantly more expensive.

When you buy artwork, you aren't buying the rights to said work. You're buying the ability to personally use/view that artwork. Which is why you can't use that kinda stuff for commercial use. :3

Also, it's necessary because if most people would ask me, as long as we talk it over and I'm asked for permission before any work is done, 7/10 times I'd probably say sure go ahead.

Actually, copyright's only to prevent the unfair exploitation of an IP at the cost of someone else. So, if I took your work and used it as my own then I'd be violating your copyright.

To the letter I would be paying you for an intangible service. Since I own the IP depicted, I'm allowing you to use it for the purpose of reproduction. In return I get a presentable depiction in your style of artwork.

You'd own: The style, the work.
I'd own the actual IP. :3c

Oh, when someone purchases artwork, they're purchasing it in its entirety. AKA, you buy an original canvas painting you then own THAT particular piece. One, not the one beside it. So, provided I only sell on, restore, edit, destroy or otherwise do with as I please with that one singular piece, it's not violating your rites. It might offend your sensibilities because I might use it for toilet paper or a throw rug. But, I'm only doing it to one specific instance. (So if I destroyed an original, there's nothing to stop you from just reproducing it and selling it again.)

There's nothing in IP law says that I can't go and have an image altered to my tastes as I see fit. I just can't profit unfairly from your design. Just like you can't profit unfairly from my character. c:

*sigh* At this point I'm going to assume you're trolling and perpetuating bad information, because I know my rights, I know the laws regarding digital works, as the one you described only pertains to PHYSICAL artworks, as there are separate rules that I stated above for DIGITAL works.

I'm very sorry I could not do business with you, but I don't really feel like arguing with someone who's not willing to be informed/adhere to a very simple and common request. I hope you have a very good day, and find artists to your liking whose philosophies are in-line with your own.

Why am I trolling all of a sudden? You do realise that my icon is just a very clever pun, right?

If you know your rites, where does it state that I would be violating copyright laws?

If you want to be technical, you'd have to look into contract law and where you and I form a separate and binding agreement.
So, if I agreed to your terms, I'd be bound by those terms. If you're wanting to go by just laws, you've got less control over them.
