Notice: Deathsia watchers

The Inkbunny user, Deathsia, has recently been banned.  

It seems there was a bit of confusion, and something a previous admin told her was okay, wasn't.  

I can't say I completely understand what's going on, but while everything as up in the air and uncertain, I considered some of my watchers might also be watching her, and should be informed about it.

I'm hoping this gets sorted out somehow. She's really upset about losing all her watchers here over something she was told wouldn't be a problem.

I suspect there's more to this story than is being said in the open. The letter from the staff clearly states that they were given multiple warnings, and even a suspension... That doesn't say to me that all was hunky-dorey in IB land. That tells me that over the course of a year they gave multiple chances, and this is now the final result.

If she was told it wasn't a problem, then why multiple warnings and suspension? Sorry, it just doesn't add up to me.

I dont wanna pick sides here but according to that e-mail she was given more then a few warning about content violations. DX

I don't think there was ANY confusion about this. It's clearly a copyright matter, the user was warned and suspended. Deathsia doesn't have any proof that she was told that this was okay by another admin, and quite frankly I find the claim that she was told it would be okay to upload copyrighted music ludicrous. If she was told that something was "okay" by another admin, it was probably that it was okay to upload screenshots, NOT copyrighted music.

Admins have to be VERY aware of copyright violations on their sites, since the DMCA gives the copyright owners the right to COMPLETELY SHUT DOWN THIS SITE if they do not comply with a DMCA takedown notice within 24 hours. One admin forgetting to check their email could result in the permanent removal of Inkbunny. Does this sound like a matter to take lightly?

As much as I feel sorry for Deathsia's plight, I have to err on the administrator's side with this one.

She claims that an admin told her the content in question was acceptable as long as it was kept locked under "Friends only"  She also claims to have a copy of the original email where she was told this.  

Like I said, I'm as confused about what happened as everyone else.  I wasn't there, I didn't read the correspondence.  My purpose for this journal is mostly to let people know she was banned, and where they can still find her work.  I'm not eager to get into an argument over who was right or wrong.

I wasn't a follower of hers, due to the content, but I did read a journal about that after someone pimped her account. I remember thinking it sounded rather odd then too... Hiding something in friends only section doesn't change the fact it's still on the site, and that can still get it shut down, so I dunno.

Either way I don't see any harm in directing people to where they can find her now.

Making something Friends-Only doesn't exempt one from the rules of the site.  I wonder if it was really a mod/admin she was talking to.

As far as I can gather, Deathsia got permission to do something which wasn't technically against the rules, but then confused this with having permission to do something else which was against the rules.

The first thing was just something that might cause a shitstorm if she made it public outside her circle of friends, but wasn't considered a bannable offense.  While the thing she was banned for could have gotten Inkbunny into legal trouble.  Basically, the things she uploaded exceeded the permission she was granted.

It's still unfortunate, because I like to think there was some way this could have been avoided.  But there really isn't anything I can do about it now.

Someone told her uploading work that didn't adhere to the 'by you, for you' clause was okay? Thaaat would be kind of weird.

I'm with some of the others in that the story doesn't make sense.  An admin told her that what she was posting was okay?  Then why does the notice say that she got multiple warnings and even a one week suspension?  If they gave her that many chances and she still kept posting the things she was being warned about, then she's far from an innocent victim of out-of-control admins.

Further proof of the fact that we should organize ourselves against the DMCA, in order to reform copyright to keep corporations from shutting down sites such as IB? Here in Europe, we already have political parties for that purpose. Polls say they're between 7-20% where I am, so that does matter in countries with proportional representation.

Whoah. Looks like I'mma watch out who I watch...and make sure Anka and the Pluto crew are PG-13 at best.

Admins obviously mean business here, unlike the drama with 'Neer I've heard about. Good on you guys. *Thumbs-up*

I was confused about what you were referring to, at first, but I think I understand now.  You have human characters, and you're just acknowledging that you'll need to be careful to not violate Inkbunny ToS by depicting those characters pornographically.  Am I right?

Well, only one of the Pluto crew is human. The others are humanoid aliens. But yes.

Oh, and the occasional Comet Girl and other assorted characters. But those are few and far between, even in my gallery xD

Hey, Even I have made mistakes here. I get pissed, I rant, and I am generally unhappy about the instances, BUT, The last thing I would do is push the envelope until my account is vaporized. While I am all for the freedoom of speech thing and the other "rights" we have, we still have to remember that the internet is essentially international waters, and that there are EVERY country's laws we have to contend with.

Oh well. C'est la vie
