There are a lot of good artists out there that I would be willing to commission, except that their commission agreement basically allows them to print, resell, reuse art that was commissioned. I can completely understand the want/need of the artist to limit the use and reproduction of their art by the buyer. But the same goes for the use of my characters.
As I am intentionally commissioning a unique work of any kind from the artist, I would like to know that it is not going to end up on some random person’s wall without my knowledge. I would also like to be sure that the artist is held liable for the reuse of my characters in their art. Below is a link to a commission agreement/contract that I could get behind. It protects both the artist and the buyer’s intellectual property, as well as the concept that I am buying a limited edition item that is not going to be reproduced and sold later by the artist.
I will not commission an artist that retains the right to reuse, reproduce and resell work that I paid for as a unique commission from them.
The payment process is not the issue. I can agree to pay up front. It is the number of artists that "RETAIN THE RIGHT TO REPRODUCE AND SELL PRINTS" of commissioned works. Their agreements as written often leave it vague or point to them retaining rights to characters used in the artwork.
This agreement would also work for fursuit makers and other art forms such as writing.
