Okay, so... there's a certain artist, don't wanna drop names in case, who's taken commission money from me and a friend (probably other people too) wayyy back who never delivered the actual artwork and pretty much swept it under the rug. I'm only bringing this up now because I see he's been taking other commissions which I sorta doubt he's completed. Personally, I've just moved on, but seeing this same thing happening to others is pissing me off.

Here's where it gets complicated. He's not really a bad guy, he's nice, probably just in a bad position. Limited net access trying to get a foothold in a place he just moved to. I'm sure if net trouble wasn't the issue people would've gotten their art already but it's wrong to just forget about what you owed people and act like it never happened, taking even more commissions he probably can't deliver.

So the question is: Does this guy deserve to be on artists-beware for the sake of people NOT getting fucked over? It's highly debatable whether he's a thief or not but bullshit is pretty much guaranteed.

if hes scamming its a scam no matter whats his shit is. you dont take peoples money and promise some thing and dont deliver. put him on blast only way to stop it

I don't think it's his intention to fuck people over. It's more like him taking commissions then going AWOL due to net problems. It's sorta understandable but at the same time he should at least give people what he owes them.

he does. :\ theres is times one must do what one must but that kinda thing isnt cool, id at least try to repay someone by drawing for them later lol and not just stealing money, thats no good. =.=

Kinda has it coming but at the same time I'm not too sure about dragging someone's name through the mud. Especially when they're just scraping by financially. In the end I just said fuck it and told him to just keep the money. Didn't learn till later that I wasn't the only one that got shafted... I got off pretty easy though considering it was only like $20 for a sketch.

Yes. Taking on commissions is a responsibility that one doesn't undergo without forethought. If you know your situation is bad, know you have issues with net and time, then you should not take commissions. If you do, and then keep their money and not draw their piece, you're violating a contract between client and employed. This is against the law, of course. Beyond that, it's a violation of trust, and obviously a purposeful violation against the commissioners to continue to do it over and over. Basically, regardless of the circumstances, they are a thief.

They knowledgeably took commissions knowing they couldn't do them or at least knowing that something might interfere and not letting people know about it proper and then doing the stuff later, then ended up NOT doing them at all,  but still, even after all this time, kept the money. They belong on artists beware, and in my opinion, deserve at least a minimum jail sentence for theft. (Multiple thefts, it sounds like.)

I dunno about jail, or even small claims court. On my end it was a miniscule loss that only ticked me off a bit. Stuff like this is why I avoid 'desperation' commissions and now stream commissions aswell @_@.

If they're doing it to a large number of people, it ceases to be a small issue, and if they do it over and over, it turns into a habitual crime.

Unintentional theft in a way. I don't think he's trying to steal commission money or anything, just bites off more than he can chew then doesn't bother to follow through. Also tried ignoring my PM's till I threatened to report him. I don't think that was very motivational for him to finish the job, but what can ya expect. Can't do stuff like that without it biting you in the ass later on.
