Cute = cub , almost naked = porn

Well apparently over at the formerly awsome site FA that cute creatures I made who's ages I established as over 18 are still cubs cuz they are small and cute. An also apparenty cubs wearing really short skirts is porn as well. *Shrugs* not that I really care anymore I'm just surprised that the margine for "cub porn" is so large. So remember almost naked, suggestive, cute things are all cub porn too so like I said before "screw you furaffinity"

'Tis why I quit FA as soon as the Cub Ban was announced.  Reading their "terms" made it clear that even non-cub images/stories that include young-looking or immature-acting characters would be blocked.  Better off without FA and their nazi-assed rules.

While I don't agree, some people think that IB is 'nazi' about human stuff. Hopefully once someone is told it's done for legal reasons they'll understand, but not always. The other misconception is that there's tons of 'cub porn' here. I did the math (as best I could) and only about 3% of all submissions on IB are adult-rated cub art. Yet that's all the haters talk about.

FA's Cub Ban was based on financial issues, not legal.  If it were a matter of law, I'd begrudgingly accept it as beyond their control.  But when it's about money, on a site that held an "Anything Legal" policy, they lose my respect and my patronage.

Technically it was the laws, but not exactly. From what I understand, AlertPay changed their stance on servicing sites that allowed 'cub'. The same thing happened here (their sales system was based around AlertPay, and they were pre-approved before they started using it). AlertPay will likely never pick FA or IB back up again due to legal reasons I'm sure, but IB continues to accept/allow 'cub' (because there's nothing wrong with fantasy) while FA is on the warpath with removing it (because they're allowing their feelings get in the way of logic, my guess). There's no reason (that I'm aware of) for them to take 'cub' down now, but they're behaving like a broad sword in the process, causing plenty of collateral damage in the process. But oh well, nothing I can do about it since it's not my site. Just got to try and stick with sane people who don't think art is real. =p

Well, as Kahei says, cute seems to equal cub. So according to FA's logic, it was cub porn, because it was so damn cute that they couldn't help but jerk off with guilt and took their insecurities out on a large community base.

(I know they did it because of legal reasons, but  I wanted to amuse people :P)

To be fair hon, that is a depiction of a character that is known to be a minor, also Disney still owns the full rights to characters. Even though this falls under the category of parody, the issue can come down the the fact he is still using the name Bambi.

Massively large global company vs independent artist, the company is going to win any law suit that comes out from a cease and desist order every time.

But people modify characters all the time. *shrugs* Just because the source material is one thing doesn't mean what an artist draws is strictly based on it. My point is that it doesn't look 'cub' at all. At best they're in their high teens, I'd say.

But no matter how you look at this, we're still talking about fictional characters. They can't be "underage" because they don't exist. >_<;

I don't think they can on parodies, can they? I'm not up on the laws about this sort of thing. So I guess change it to 'Banbi' and apparently it would be safe. =p

Teen is still a minor and while I agree with the fact that a drawing of a fictional character, not to mention a fantasy creature, has no actual age you can tell he is suppose to be a young deer from the horns and fur patter. There is also fact that the muscle and bone structure more closely resembles that of a young man going through the early stages of adolescences versus that of an adult... ^^;

Trademarks can be tricky. Companies own full rights to character's name and image, in some cases. Obviously the name Bambi is too common for Disney to own the rights, nor do they own the rights of depictions of a young dear. What they do own is the specific image of the animated deer known as Bambi and even if done in parody including altering the image so is of an anthro, they could still choose to bring a suit down out of principle... I have seen them do it before. They may not have a strong case, but the average joe cannot afford to go through the court system and companies have been known to purposely drag out litigation simply to leave someone destitute, they don't actually care if they win the suit or not, by destroying the individual they have still won.

Oh well, most fan artists are fine as long as they don't try and use the character as a logo, make any claims of ownership, or make money off their fan works. Which some do and it annoys the hell out of me, no self respecting artist should be trying to make a buck off another artist's characters.

Seriously, even though they said their would be no witch hunting, there is no way to get around it. Anything at all that even looks like the character might be young and in any suggestive appearance is going to get banned on FA. In one part I can understand that in order to keep their hosting they need to take these kinds of stances, but still it irks me people are this stupid. A fictional, non-human, character no matter how they may look have no actual age, that is all dependent on the person that made the character. If someone sees an actual child being depicted, than they have something mentally going on that makes them want to see it as a child.

People that cannot tell the difference between fantasy and reality scare the shit out of me. There is no morality issue involved with a young looking fictional creature being depicted in sexual situations. How the hell their mind connects that to child porn is beyond me.

Yeah, pretty much, just stick with IB here. FA's going to landslide downwards, and IB will be there to throw people a rope if they want to climb back up. :)
