Not What I Was Expecting

I paid $40 and waited 6 months for this pic to be done: https://inkbunny.net/s/1888683 only to learn just now that aside from a blue sky being added...its finished...WTF! Thats barely a sketch! I could have gotten better work from someone on here. Im very upset.

As much as a lot of furs here are better about things you'll find some that say they still hold rights over the art even after paid and will bitch about violation of ToS. Showed the ToS of one widely used artist here to a lawyer and he laughed saying nothing she has in her ToS would stand up in a court. No artist can claim they own art someone paid for nor can they stop you from having another add color to a black and white they draw. You'll find a whole new set of issues from artists here with ToS and how much of a joke the law sees it as. Not saying don't buy from tham just be ready for some drama when they try to enforce ToS they have no lawful right to enforce.

I was just reading a tos on FA ironically enough that said if you upload the pic anywhere but on FA he will report it and have it removed...thats ridiculous. You own the pic once they take your money. You made a lawful purchase. I buy something from you you cant say you dont like how I use it and take it back.

You are quite wrong there. After you paid for a commission you own it on the terms stated in the contract or ToS. As a customer you are just as bound to these as the artist is. It is very important to have a clear contract because of that. I'll just give you one example: Imagine you commission an artist to draw a character for you for the first time. There are no other pictures of this character or public texts that describe their appearance in detail. Unless stated in the commission contract, the artist will automatically hold the copyright to this character. That's automatic and a basic fact of copyright law. The artist may even be unaware of this or doesn't even want to hold any copyright to your character but you just lost it anyway. This is why contracts and ToS are binding (as long as they don't contradict any laws) and you really need to read them before commissioning someone.

But as the one who paid money it becomes your property. They own the copyright until they give the pic to you. Also when communicating to the artist the details you just created intellectual property and are paying the artist to render it. And the communication becomes proof your copyright. And based on contract law all online ToS are void and fraud unless the commissioner gives full disclosure that the ToS is a contract.

You can not transfer copyright by merely handing over a finished work and neither are your private telegram messages to the artist an act of creating IP but you don't have to take it from me.
