Is Marriage legal?

If Marriage is a government program to keep the senses and taxes balanced then it is a government institution and all marriage go or straight is legal and all Religious organizations have no say.
OR
If Marriage is a Religious Institution that Violates the Constitution do to mixing Religion and The government as well as The government Taxing a Religious Organization which is the same as bribery.

So Either it's a government thing and all is legal OR it's religious which it's not.

Alas, the separation of church and state is (a) primarily to prevent a state-sponsored religion, (b) not well practiced over the long history of this country, because of the desire for people in power to regulate morality, and (c) has become so mixed in this country that it satisfies one of the 14 conditions for a fascist state... and the other 13 are close behind. (see http://www.ratical.org/ratville/CAH/fasci14chars.html)

Originally, marriage was a legal conveyance; it helped to tie up large quantities of wealth among higher-class families, preventing them from passing into the hands of strangers by providing offspring who would inherit. Even now, marriage, at its heart, continues to be a legal conveyance, as it can be accomplished by a Justice of the Peace, with witnesses to signed documentation, rather like a transfer of property, or a will, or whatever. However, the government -- which is overly concerned with its vision of morality -- still can dictate what conveyance is legal and what is not. Interestingly, much of what is covered in marriage can be created lawfully between any two or more people, through a lot of paperwork and creations of entities such as LLCs and so forth. Being married, however, does it all much more quickly and simply, so the push for gay marriage continues.

What we need to do is acknowledge that there are only two types of law: Laws of Cooperation, and Laws of Morality. Laws of Cooperation say, drive on the right side of the road, stop at a red light, don't steal someone else's stuff because you'll be mad if they steal yours. Laws of Morality say, selling sex is wrong, gambling is wrong, same-sex marriage is wrong. So let's eliminate all Laws of Morality and get on with cooperating only insofar as needed to be able to coexist in this idiot world. "Morality" is about power and penises... like religion is. It's poisonous, dangerous, and outmoded. Let's get rid of it.
